MODIFICATION OF THESE TERMS AND DURATION

MONICA MARTINEZ GONZALEZ may modify the terms and conditions set forth herein at any time, and such modifications will be duly published as they appear here. The validity of the aforementioned terms and conditions will be subject to their publication and will remain in effect until they are modified by others duly published. The last modification of the terms and conditions was made on November 18, 2020.

SAFETY

The website uses industry-standard information security techniques, such as firewalls, access control procedures, and cryptographic mechanisms, all for the purpose of preventing unauthorized access to data. To achieve these ends, the user/client agrees that the provider may obtain data for the purpose of the corresponding authentication of access controls.

Our secure server guarantees the privacy of the data you transmit to us. This privacy is achieved through the SSL protocol, encrypting the data sent using the RSA encryption system, so that no one can take possession of it as they do not have the necessary key. You can verify that your browser is secure if the padlock symbol appears, and you can also notice that the URL changes slightly: it no longer begins with http but with https.

SHIPPING COSTS

Shipping and/or handling fees are not included in the price and will be shown to you before completing your purchase, depending on the shipping address for each order. Below, we detail the shipping costs in the following table:

  • Spain: €2.95 (mainland), €4.95 (Balearic Islands)
  • For shipments to the Canary Islands, please consult us first.
  • Europe: €8.95. Rest of the World: €9.95

Delivery time in Spain: 1 to 2 days.

ORDER FULFILLMENT

To place an order, you need to log in to www.sunandbed.com and register as a user by completing the electronic form that appears on the online store's website at any given time and following the instructions indicated on it. After registration, and to proceed with purchasing products, you must add the product you wish to acquire to your cart, according to the instructions displayed on the screen, completing the order form provided for this purpose and validating it.

The prices shown on the website are valid solely and exclusively for online orders placed at www.sunandbed.com. All prices published on our website include VAT.

The customer's order validation expressly implies knowledge and acceptance of these general terms and conditions as part of the contract's formation.

Once the purchase is made and as soon as possible, always before 24 hours have passed since the purchase was executed, MONICA MARTINEZ GONZALEZ's Customer Service will send you a purchase receipt by email.

If you disagree with the information included in that confirmation, you may request that it be corrected or that the contract be canceled.

CONTRACT FORMALIZATION LANGUAGE

The language or languages in which the contract may be formalized on this website is Spanish.

PRODUCT AVAILABILITY

The selection of products offered at www.sunandbed.com is valid as long as the products are visible on the website. Since this is an e-commerce site, inventory is updated online, so it is possible that stock may run out during the purchase process.

If this were to happen, we would notify you immediately to offer you an alternative or refund the amount you paid for the product.

HOW TO FILE A CLAIM

To make any claims related to the obligations established in Article 110 of Law 3/2014, you must contact us.

FAILURE TO PERFORM THE CONTRACT

If the entity fails to fulfill the contract because the purchased product is unavailable or for any other reason, the customer will be notified of this unavailability and/or the reason for it, and any amounts paid under the contract will be refunded without undue delay.  In the event of an unjustified delay by MONICA MARTINEZ GONZALEZ in returning the amounts paid, the client may claim double the amount owed, without prejudice to their right to compensation for damages suffered in excess of said amount.

SHIPPING METHODS AND DELIVERY TIMES

Products will be shipped to the shipping address you indicated in your order. If you order multiple items with different availability, the delivery time will be based on the longest estimated delivery time. In exceptional cases, MONICA MARTINEZ GONZALEZ reserves the right to split the order, sending available items and postponing the shipment of unavailable items to a second delivery.

To carry out the transport and delivery of shipments, we have chosen a reputable courier company.

The estimated shipping time will depend on the order placed. It will be approximately five business days from the date payment is received, with business days defined as Monday through Friday.

In the event that the client detects any problem at the time of delivery of their order (damaged packaging, missing or deteriorated products), they must indicate it in writing on the carrier's delivery note and contact us within 14 days of receipt. No returns of damaged items, nor claims for missing items, will be accepted unless communicated within the established period, sending us photos and a description of the problem.

”All of the above is without prejudice to the warranty rights to which every consumer is entitled for products that do not conform to the contract, in accordance with applicable law.”.

PAYMENT

MONICA MARTINEZ GONZALEZ accepts credit card payments; you can use Visa and MasterCard. If you pay with a Visa or Maestro card, the charge will be processed on a deferred basis—that is, at the time of shipment. This means you will only be charged for the items shipped, and only at the time of shipment. In the event that the POS terminal reports a card decline, the order will be automatically canceled, and the customer will be notified online of the cancellation. For payments made with cards issued outside of Spain, the issuing bank must adhere to the Secure Electronic Commerce (CES) Security Protocol. Payments with cards that do not meet this requirement will not be accepted. As an alternative, we offer payment by bank transfer. MONICA MARTINEZ GONZALEZ reserves the right to reject any transaction made with a credit card. In this case, we will proceed to refund the amount to the original card. In such cases, if the customer wishes to proceed with the purchase of the items, we will request a bank transfer.

RIGHT OF WITHDRAWAL

If you are not satisfied, you can return your purchases made at www.sunandbed.com to our office located at Domènec Sugrañes i Gras 15 - 43840 Salou by filling out the return form, which you can download here.

The deadline for requesting a refund is as follows, starting from the date the order is received:

- 14 calendar days for all products in our online store.

The refund will be issued via the same payment method used for the purchase. This right is in addition to the warranty rights established in Royal Decree-Law 1/2007 of November 16 on the protection of consumers and users.

The circumstances that can lead to a return are as follows:

a) If you are not satisfied with the product you ordered: You may return it via courier to MONICA MARTINEZ GONZALEZ. We will refund the cost of the product but not the return shipping costs.

b) If you wish to exchange the item for another one, MONICA MARTINEZ GONZALEZ will not cover the return shipping costs

c) Product that, by mistake, does not correspond to the one ordered: MONICA MARTINEZ GONZALEZ will bear the costs of picking up the incorrect product and delivering the one corresponding to the order placed.

d) The products must be packaged and unopened. The packaging must be in perfect condition and retain all its original accessories and instructions in order to be returned.

Returns of products not purchased from MONICA MARTINEZ GONZALEZ will not be accepted, neither in physical stores nor in the online store.

In all cases, products must be in perfect condition, in their original packaging, and include any manuals, accessories, or promotional gifts, if applicable.

In accordance with Article 103 of Law 3/2014 on the Protection of Consumers and Users, the right of withdrawal does not apply to products that are clearly personalized or that have been manufactured according to the customer’s specifications.

ORDER CANCELLATION

If an order is canceled before shipment, the customer will not incur any charges. If an order is canceled after the merchandise has shipped, the customer will be responsible for shipping costs as well as the cost of returning the order.

PRODUCT WARRANTY

The warranty period is 2 years from the product delivery. However, this warranty does not cover defects caused by negligence, impacts, improper use, or mishandling, nor materials worn due to use. Unless proven otherwise, it will be presumed that any lack of conformity manifested within 6 months of product delivery, whether new or used, already existed when the item was delivered, except when this presumption is incompatible with the nature of the product or the nature of the lack of conformity. MONICA MARTINEZ GONZALEZ reserves the right to request an official brand service center to verify the origin of the problem. In cases where the defect is found to be caused by misuse, the repair will be chargeable. In situations that justify the application of the warranty, the options will be repair, replacement of the item, a price reduction, or a refund, under the terms established by law.

REFUND OF AMOUNTS PAID

The refund will be processed through the payment method you used for the purchase.

MONICA MARTINEZ GONZALEZ will not issue a refund or reship items until the receipt and condition of the packaging and accessories of the returned or exchanged item have been verified in our warehouses. The price to be refunded is the one originally listed in the order, excluding shipping costs. Once the correct condition of the returned product has been verified, MONICA MARTINEZ GONZALEZ will proceed with the refund within a maximum of 15 days.

APPLICABLE LEGISLATION AND JURISDICTION

The relationship between MONICA MARTINEZ GONZALEZ and the USER shall be governed by current Spanish regulations, and any dispute shall be submitted to the Courts and Tribunals of the corresponding city.
